1. Who you are contracting with

These Terms govern your use of Cobuild Trade Hub (the "Service"), operated by Lisa Windley ("we", "us", "our"). By creating an account or using the Service you agree to these Terms. If you are using the Service on behalf of an organisation you confirm you have authority to bind that organisation.

2. The Service

Cobuild Trade Hub helps tradespeople generate designs, quotes and client-facing materials using AI-assisted tools. We provide the Service on a subscription basis under the plan you select.

You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Provide accurate information and keep it up to date.

6. Intellectual property

We retain all rights in the Service, including the software, models, documentation, and branding. We grant you a limited, non-exclusive, non-transferable right to use the Service within your chosen plan. You retain rights in your inputs and, subject to these Terms, in generated outputs you produce.

7. Payments, billing and refunds

Payments are processed securely by Stripe. By subscribing you also agree to Stripe's Stripe Services Consumer Terms. Applicable VAT / sales tax is added at checkout where required. Refunds are handled under our Refund Policy.

8. Service availability

We aim to keep the Service available but do not guarantee uninterrupted or error-free operation. To the fullest extent permitted by law we disclaim all implied warranties, including merchantability and fitness for a particular purpose.

9. Suspension and termination

We may suspend or terminate your access for material breach of these Terms, non-payment, security or fraud risk, or repeated or serious policy violations. On termination your right to use the Service ends; we will provide a reasonable window to export your data where practicable.

10. Liability

To the fullest extent permitted by law, our aggregate liability arising out of or in connection with the Service is capped at the fees you paid us in the 12 months before the event giving rise to the claim. We are not liable for indirect or consequential loss, including loss of profits, data, goodwill, or business opportunity. Nothing in these Terms limits liability for fraud, death, or personal injury caused by negligence, or any other liability that cannot be limited under applicable law.

11. Indemnity

You will indemnify us against claims arising from your content, your unlawful use of the Service, or your breach of these Terms.

12. Changes

We may update these Terms from time to time. Material changes will be notified through the Service or by email. Continued use after changes take effect constitutes acceptance.

13. Governing law

These Terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction over any dispute, except where applicable consumer law gives you the right to bring proceedings elsewhere.
